A worker who suffered a serious head injury during a renovation of a Brooklyn warehouse now an Amazon facility won a $25 million settlement. The lawsuit claimed a contractor falsified safety logs. The worker fell through a roof hole, was unable to work, and sued multiple parties. The settlement details were initially redacted but later revealed the worker will receive $22 million and his wife $3 million. The settlement involves multiple defendants, including the contractor and firms involved in the project. The safety supervisor whose name was forged on safety logs filed a complaint with the city, but the Department of Investigation has not provided updates. The contractor’s owner could not be reached for comment.
Worker Wins $25 Million Settlement in Brooklyn Warehouse Accident Lawsuit Against Amazon Contractor
A worker who sustained a severe head injury during the renovation of a Brooklyn warehouse now used as an Amazon shipping facility has been awarded a $25 million settlement in a lawsuit. The case alleged that a contractor had falsified safety logs to incorrectly indicate that the site was safe before the accident occurred.
The incident took place in May 2018 when Abbos Abbosov fell through a hole in the roof of the building on Cozine Avenue in East New York. He was part of a crew removing asbestos when the accident happened, resulting in a serious head injury that required multiple hospitalizations and rendered him unable to work.
Abboso filed a lawsuit against various parties involved, including the demolition contractor, Bordone Construction. As part of their defense against the lawsuit, Bordone submitted safety log entries that purported to have been signed by a licensed construction site supervisor. However, the supervisor denied being part of the demolition work and refuted signing the logs, as reported by THE CITY.
In March, the parties reached a settlement in the case. While the specific dollar amounts paid by the defendants were initially redacted in court documents, an unredacted document later revealed that Abbosov would receive $22 million, with an additional $3 million being awarded to his wife, Albina Abbosova.
The settlement terms stipulate that the payments will be distributed among Bordone, GSC Services (the asbestos abatement firm employing Abbosov), an engineering firm, and a limited liability corporation that owns the warehouse and developed the property for Amazon.
Following the discovery of the falsified safety logs submitted by Bordone, site-safety supervisor Lisa Bagnoli raised a complaint with the city Department of Investigation. Despite her efforts, she initially received no response and only engaged with an investigator in March after following up. However, she asserts that communication from the Department of Investigation ceased thereafter.
In response to inquiries about the case, Diane Struzzi, a spokesperson for the Department of Investigation, acknowledged the allegation made in 2023 but declined to provide further comment.
Efforts to reach Joseph Bordone, the owner of Bordone Contracting, for a statement were unsuccessful.
In conclusion, the $25 million settlement highlights the importance of safety protocols and the consequences of negligence in the workplace. The case serves as a reminder for companies to prioritize employee safety and adhere to regulations to prevent such tragic incidents.
