Prosecutors claim dashcam video of staged crash uploaded to TikTok has over 74 million views.
A man from Brooklyn, identified as Maikel Martinez, has been charged with insurance fraud, staging a motor vehicle accident, reckless endangerment, and other offenses following an incident captured in a viral TikTok dash cam video on a busy Queens highway. The video showed Martinez and three others in a silver Honda allegedly cutting off another driver on the Belt Parkway in October. The driver, Ashpia Natasha, swerved to avoid a collision, but Martinez’s vehicle then backed into her car, causing significant damage amounting to $8,300 to her 2021 Acura RDX.
In an interview with The New York Times, Natasha described the incident as happening rapidly, expressing concerns that the individuals in the other vehicle may have had harmful intentions towards her. Queens District Attorney Melinda Katz issued a statement condemning the reckless behavior, highlighting the potential danger posed to numerous lives due to the staged crash. Staging a car accident for insurance purposes is considered a felony in New York.
Martinez, aged 28, was apprehended upon his return to New York from Ecuador and could face a maximum sentence of seven years in prison if found guilty. In addition to the aforementioned charges, he also faces accusations of criminal mischief and conspiracy. The Queens Defenders, a legal group providing representation for Martinez, opted not to comment on the case.
The incident on the Belt Parkway underscores the serious consequences of fraudulent activities involving staged car accidents. Such schemes not only put innocent individuals at risk of harm but also contribute to insurance fraud, leading to financial losses for insurers and policyholders alike. Law enforcement agencies continue to investigate such incidents to uphold the law and ensure the safety of all road users.
